Terms and Conditions of Sale

These Terms and Conditions of Sale (the “Terms”) govern all purchases made through the Perdeberg Wines website at perdeberg.co.za (the “Website”), including individual online orders and orders placed by members of the Perdeberg WineClub. They are published by Perdeberg Wines (Pty) Ltd, registration number 2003/014414/07, of Vryguns Farm, Windmeul, Paarl, 7620, South Africa (“Perdeberg”, “we”, “us” or “our”).
These Terms should be read together with our Terms of Use, Privacy Policy, Delivery Policy and Returns Policy, all of which are available on the Website and form part of the agreement between you and Perdeberg. If there is a conflict between these Terms and any of those documents on a matter relating specifically to a sale, these Terms will take precedence.
By placing an order on the Website or joining the Perdeberg WineClub, you accept these Terms in full. If you do not agree to any part of these Terms, please do not place an order or join the WineClub.
- Age Restriction and Responsible Use
1.1 Our products are alcoholic beverages. You must be 18 years or older to purchase wine from us or to join the WineClub, in accordance with South African law.
1.2 We may require proof of age on delivery. Our couriers are entitled to refuse delivery to anyone who cannot show valid identification or who appears to be intoxicated.
1.3 We encourage responsible consumption of alcohol at all times. Not for sale to persons under the age of 18.
- Prices
2.1 All prices on the Website are shown in South African Rand and, unless stated otherwise, include VAT at the applicable rate.
2.2 Prices are subject to change at any time and without prior notice. This includes changes due to input costs, exchange rates, harvest conditions and general market conditions.
2.3 We will always charge the price displayed on the Website at the time you place your order. A later change in price will not affect an order you have already placed and paid for.
2.4 If a pricing error appears on the Website, we reserve the right to correct it. Where an order has already been placed at the incorrect price, we will contact you to confirm whether you would like to proceed at the correct price or cancel the order.
- Product Availability and Vintages
3.1 Our wines are produced in limited vintages. Availability of any specific vintage is limited to existing stock. Once a vintage is sold out, it will not be replenished.
3.2 If your chosen vintage sells out, you will need to wait for the next available vintage of that wine to be released. We cannot guarantee when this will happen, or that the new vintage will be identical in style, blend or price to the one you originally selected.
3.3 We will let you know as soon as reasonably possible if a product you have ordered is out of stock. Where this happens, we will offer you a substitute vintage where available, the option to wait until the new vintage is released, or a full refund for the affected item.
- Discounts and Promotions
4.1 Only one discount may be applied to any single wine or product per order. Where a wine already qualifies for a promotional or sale price, no further discount, including a WineClub member discount, voucher or other promotional code, may be applied to that same wine in addition.
4.2 Where a customer would otherwise qualify for more than one discount on the same product, we will apply whichever single discount is most favourable to the customer, unless we specify otherwise for a particular promotion.
4.3 Discounts do not apply to gifting products, the Soft Smooth Range or the Lighthearted Collection, unless we state otherwise.
4.4 We reserve the right to amend, withdraw or extend any promotion or discount at our discretion.
- Orders and Payment
5.1 An order is only accepted once payment has cleared. Wine is released from our cellar for delivery or collection only once payment has been received in full.
5.2 We reserve the right to refuse or cancel any order, including where stock is unavailable, where a pricing or listing error has occurred, or where we suspect fraudulent activity.
5.3 You are responsible for ensuring that the delivery address and contact details you provide are correct. Additional charges arising from a refused, returned or misdelivered order due to incorrect details supplied by you will be for your account.
- Delivery
6.1 Delivery is available within South Africa only. If you wish to order for delivery outside South Africa, please contact us at info@perdeberg.co.za before placing an order.
6.2 Estimated delivery times and related terms are set out in our Delivery Policy, available on the Website. While we aim to meet estimated delivery timeframes, we cannot guarantee delivery within a specific period, as this depends on factors including courier performance and stock availability.
- Returns and Refunds
7.1 Returns and refunds are handled in accordance with our Returns Policy, available on the Website. In summary, unopened products may be returned within 30 days of delivery where the return results from our error or from damage that occurred before delivery.
7.2 Opened bottles cannot be returned, except where required by law.
- The Perdeberg WineClub
8.1 The Perdeberg WineClub is our membership programme for customers who wish to receive ongoing benefits on their wine purchases. Membership is open to individuals aged 18 or older.
8.2 There is no joining fee to become a WineClub member. To join, and to remain a member in good standing, you must purchase a minimum of 12 bottles per year from Perdeberg.
8.3 WineClub members receive a discount of 10% on the Perdeberg Cellar Collection and 15% on the Vineyard Collection, The Dry Land Collection and our Iconic Range (Rex Equus and Endura), subject to clause 4 above and the exclusions in clause 8.4.
8.4 Member discounts do not apply to gifting products, the Soft Smooth Range, the Lighthearted Collection, or any product already on promotion.
8.5 We provide free door to door delivery within South Africa on WineClub orders. Orders are generally dispatched within approximately 5 business days of payment clearing. Any charges arising from an order that is refused, returned or misdelivered due to incorrect information supplied by the member will be for the member’s account.
8.6 WineClub membership also includes one complimentary tasting per year for the member and up to 3 guests, a 10% discount at our restaurant for up to 4 guests, a 10% discount on venue hire for private events, invitations to exclusive member events, and early notice of new releases, each subject to availability and any additional conditions we may communicate from time to time.
8.7 We may amend WineClub benefits, discount levels or the minimum annual purchase requirement from time to time. We will give members reasonable notice of any material change.
8.8 A member’s failure to meet the minimum annual purchase requirement in clause 8.2 may result in the suspension or cancellation of their WineClub membership and associated benefits. A member may cancel their membership at any time by giving us written notice at wineclub@perdeberg.co.za.
- Privacy
We process personal information collected through the Website and the WineClub in accordance with our Privacy Policy, available on the Website, and in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA).
- Intellectual Property
All content on the Website, including text, images, logos and the Perdeberg brand, is owned by or licensed to Perdeberg Wines (Pty) Ltd and may not be reproduced or used without our prior written consent.
- Limitation of Liability
To the maximum extent permitted by law, Perdeberg will not be liable for any indirect or consequential loss arising from your use of the Website or from any order, other than in respect of death or personal injury caused by our negligence, or any other liability that cannot be excluded or limited under South African law. Nothing in these Terms limits your rights under the Consumer Protection Act 68 of 2008.
- Changes to these Terms
We may update these Terms from time to time to reflect changes in our products, pricing practices, WineClub structure or legal requirements. The version published on the Website at the time you place an order will apply to that order.
- Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms will be dealt with in accordance with the dispute resolution provisions of our Terms of Use.
